Can I open up an escrow account for a non-business matter?

Im involved in a lawsuit with my homeowners association and have not been paying the monthly maintenance fees for awhile now. Would I be able to put every months fees to an escrow account just to show that in good faith I am willing to pay, just not to them at this time? I%26#039;m not too sure how all of this works? Can you elaborate please?
